Casual Exchange Laws

Clayton lost his life due to a violation of the Casual Exchange Law TCA code 39-13-210 Second Degree Murder which states that the killing of another which results from the unlawful distribution of any schedule 1 or schedule 2 drug is the proximate cause of death of the user. TCA Code 39-17-418 was also violated in Clayton’s case. This code states that it is a violation of subsections (a) or (b) where there is a casual exchange to a minor from an adult who is at least two years such minors senior, and knows that a person is a minor is punished as a felony as provided in section 39-17-417. TCA code 39-17-417(k) states that a violation of this section where the recipient or the intended recipient of the controlled substance is under 18 years of age shall be punished one classification higher than provided in subsections (b) – (i).

Currently the only criminal charge that has been filed in Clayton’s case is one charge of Contributing to the Dequincy of a Minor. Clayton’s family continues to pray that someday the adults that provided him with the drugs that ended his life with be charged with this Casual Exchange Law Violation.
